1. Who you are contracting with
The platform is operated by Gareth Foley, a sole proprietor based in South Africa, trading as OmniGrowth BPO. Our place of business is 1 Glissando Crescent, Radiokop, Johannesburg, Gauteng, 1724, South Africa. In these terms “we”, “us” and “our” mean that business, and “you” means the person or business holding the account.
Our country of domicile is South Africa. This agreement, and every sale made through this website, is governed by the laws of the Republic of South Africa.
2. What the service is
OmniGrowth BPO Pro is a subscription software-as-a-service platform, delivered entirely over the internet in your web browser. There is nothing to install and nothing is shipped to you. It is built for freelancers, agencies and outsourcing (BPO) operators who win project work online, and a subscription gives you access to all of the following:
- Project acquisition. Search and filter outsourced project listings, save searches, import a project by URL or by pasting a brief, and score opportunities against criteria you set.
- AI proposal engine. Generate tailored proposal drafts from a project brief, in a tone and length you choose, with scoring and a library of proposals that have won work. Drafts are produced by a third-party AI model and are a starting point for you to edit — see clause 9.
- CRM pipeline. Track every opportunity through an eight-stage pipeline with follow-up reminders and client health indicators.
- Communications hub. Keep client messages, follow-ups, notifications and activity in one place.
- Talent network. Build a bench of vetted developers, organise them into pools and match them to the projects you win.
- Delivery workspaces. Run delivery with tasks, channels, milestones, files, notes and team access.
- Client portal. Give your own clients a branded, secure view of project progress and approvals.
- Analytics, earnings tracking and training content, plus the platform updates we release during your subscription.
There is a single plan. Every feature listed above is included on every billing period — we do not gate features behind tiers, and there are no add-ons to buy separately.
3. Your account
You need an account to use the platform. You must give accurate registration details, keep your password confidential, and tell us promptly if you think someone else has access to your account. You are responsible for everything done through your account.
An account is for one business. You may invite team members to workspaces where the platform provides for it, but you may not share a single login between people, resell access, or operate the platform on behalf of third parties as a service without our written agreement.
You must be at least 18 years old and legally able to enter into a contract. If you register on behalf of a company, you confirm you are authorised to bind it.
4. No free trial; payments are final
There is no free trial. You choose a plan when you create your account and pay for it, and you get the whole of OmniGrowth BPO Pro immediately. Because access is complete and immediate, subscription payments are final on these terms:
- No refund window. We do not offer a money-back guarantee, cooling-off period or refund on any plan for changing your mind, not using the platform, or the unused part of a month or a prepaid term.
- See it first if you want to. Before you pay you can book a demo at no cost, and you can start on the monthly plan, which has no minimum term, before committing to a longer one.
- Money taken in error is returned. A duplicate charge, a charge after a cancellation we accepted, a charge for the wrong amount, or a payment for access we could not provide is always put right — see clause 8 and our refund and cancellation policy.
- Your statutory rights are unaffected. Nothing in this clause limits any right you have under applicable consumer protection law.
5. Subscription, prices and billing
A paid subscription starts when you choose a plan and PayFast confirms your payment. All prices on this website are quoted and charged in South African Rand (ZAR). The current prices for OmniGrowth BPO Pro are R1,799 / month, R4,799 / 3 months, R8,999 / 6 months or R16,990 / year. Prices are shown on the pricing page and at checkout, and are the amounts that will be debited.
- Monthly subscriptions renew automatically each month until you cancel.
- Prepaid terms (3, 6 or 12 months) are paid up front and run for the full term you bought.
- Recurring payments are collected by PayFast against the card or account you used at checkout, on the same date each cycle, until the subscription is cancelled.
- Failed payments. If a payment fails we keep your account open for a short grace period while the payment is retried. If it is not settled, access is suspended until it is.
We may change our prices. A price change never affects a term you have already paid for; it takes effect on your next renewal, and we will give you reasonable notice before it does so you can cancel if you would rather not continue.
Where a promotional code is applied to your account, it grants the number of free months stated for that code. Promotional codes have no cash value, cannot be exchanged for a refund, and may be withdrawn or expire.
6. Payment, and how your card details are handled
Payments are processed by PayFast, a South African payment gateway. When you subscribe you are redirected to PayFast’s own secure payment page to enter your payment details, and PayFast notifies us when the payment succeeds. The payment methods available are:
- Visa and Mastercard credit and cheque cards
- Instant EFT from major South African banks
- Debit orders on recurring subscriptions (authorised through PayFast)
- Masterpass, SnapScan, Zapper, Mobicred and other methods PayFast may enable
Card numbers, expiry dates and CVV codes are entered on PayFast’s payment page and are never transmitted to, processed by, or stored on this website or our servers. We hold no card data at all.
The customer information we do hold — your name, email address, account settings and the record of which payments succeeded — is stored separately, in our own database, and is never stored together with card details. All traffic to this site is encrypted with TLS.
We record an invoice against your account for each successful payment. You can see your billing history at any time in the Billing section of the app.
7. Delivery of the service
Access is delivered electronically. Once PayFast confirms your payment, your account is unlocked automatically — typically within a few minutes — and there is no physical shipment. The full details, including what to do if access has not appeared, are in our delivery policy.
8. Cancellation and refunds
You can cancel your subscription yourself, at any time, from the Billing section of the app. Cancelling stops future billing. You keep access until the end of the period you have already paid for, and there is no cancellation fee, notice period or minimum term on the monthly plan.
Subscription payments are final (clause 4). That includes changing your mind after paying, stopping using the platform, and the unused part of a month or of a prepaid term, which runs to the end of the term you bought. Nothing in this clause limits any right you have under applicable consumer protection law, including the Consumer Protection Act 68 of 2008 or section 44 of the Electronic Communications and Transactions Act 25 of 2002 where they apply.
We do return money that should never have left your account — a duplicate charge, a charge after a cancellation, or a charge for the wrong amount. The full position, including what happens if a cancellation cannot be completed automatically, is set out in our refund and cancellation policy, which forms part of this agreement.
Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002. Section 44 of the ECT Act gives consumers seven days to cancel certain electronic transactions; its exclusions generally cover digital services the consumer has begun using, which is the position once you have signed in on a paid plan. Where the law gives you a right that goes further than this clause, the law applies.
9. AI-generated content
The proposal engine and other AI features send the project brief and the profile information you supply to a third-party AI provider (currently OpenAI) and return generated text. That text is a draft. It can be wrong, generic, out of date, or unsuitable for the client you are sending it to.
You are responsible for reviewing, editing and approving anything you send to a client, and for making sure it is accurate and truthful. We do not warrant that AI-generated output is accurate, original or fit for any particular purpose, and we are not a party to any contract you conclude with your own clients.
10. Third-party platforms and integrations
The platform can connect to third-party services such as Freelancer.com using credentials or API keys that you provide. Those services are not ours. Your use of them stays subject to their own terms, and you are responsible for complying with those terms — including any rules they have about automated access, bidding and messaging.
We cannot guarantee that a third-party service will remain available, that its interface will not change, or that data imported from it is complete or accurate. If a third party changes or withdraws its service, we may have to change or remove the related feature.
11. Acceptable use
You agree not to:
- use the platform for anything unlawful, fraudulent, misleading or abusive;
- send spam or unsolicited bulk messages, or use generated content to misrepresent your skills, experience or identity;
- attempt to gain unauthorised access to the platform, other accounts or our infrastructure, or probe, scan or test its security;
- copy, scrape, reverse engineer, resell or create a competing product from the platform or its content;
- upload malware, or content that infringes someone else’s rights;
- place unreasonable load on the service, or circumvent any usage or rate limit.
12. Your data and our intellectual property
You keep ownership of everything you put into the platform — your projects, proposals, client records, files and notes. You grant us the limited licence we need to host, process and display that content in order to provide the service to you, including sending the relevant parts to the sub-processors listed in our privacy policy.
We keep ownership of the platform itself: the software, design, branding, templates, training material and documentation. Your subscription is a licence to use it while your subscription is active. It does not transfer any ownership to you.
You can export or copy your data out of the platform while your account is active. After your subscription ends we keep your data for a limited period as described in the privacy policy, after which it may be deleted.
13. Availability and support
We work to keep the platform available and to fix faults promptly, but we do not promise uninterrupted or error-free service. Maintenance, third-party outages and events outside our control can interrupt access.
Support is provided by email at gareth@omnigrowthbpo.com and through the in-app support channel, Monday to Friday, 09:00–17:00 South African Standard Time (SAST). We aim to respond within one business day.
14. No guarantee of results
OmniGrowth BPO is a tool. It does not guarantee that you will win projects, earn a particular amount, or build a profitable business. Case studies, examples and figures published on this website describe what particular users report and are not a promise of what you will achieve. Your results depend on your own skills, effort, pricing and market.
15. Suspension and termination
You may stop using the platform at any time by cancelling your subscription. We may suspend or terminate your account if you materially breach these terms, if payment is not made, or if we are required to do so by law. Where it is reasonable to do so we will warn you first and give you a chance to put things right.
If we terminate your account without cause partway through a prepaid term, we will refund the unused portion of that term.
16. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act. Subject to that:
- we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of data;
- we are not liable for the acts or omissions of your clients, your contractors, or any third-party platform you connect to;
- our total liability to you for any claim is limited to the amount you paid us for the subscription in the twelve months before the claim arose.
You agree to indemnify us against claims brought by third parties arising from your use of the platform in breach of these terms, or from work you deliver to your own clients.
17. Privacy
How we collect and use personal information, who we share it with and the rights you have under the Protection of Personal Information Act 4 of 2013 (POPIA) are set out in our privacy policy, which forms part of this agreement.
18. Changes to these terms
We may update these terms as the product and the law change. The version published on this page is the one that applies, and the date at the top shows when it last changed. If a change materially reduces your rights we will give you notice before it takes effect on your next renewal. Continuing to use the platform after a change means you accept the updated terms.
19. Complaints, governing law and jurisdiction
If something has gone wrong, email gareth@omnigrowthbpo.com or call +27 65 865 3451 and we will try to resolve it with you directly first.
This agreement is governed by the laws of the Republic of South Africa, and you and we consent to the jurisdiction of the South African courts. Our country of domicile is South Africa and our address is 1 Glissando Crescent, Radiokop, Johannesburg, Gauteng, 1724, South Africa.
If any clause of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it.
